Comera - Terms of Use

Comera is a free end-to-end encrypted calling and messaging app that provides text messaging, calling (voice + video calls), group chats, and file and multimedia sharing, among other communication services. By installing, accessing, and using the app and its features, including the ones that are periodically updated, added, and modified, you agree to the terms and conditions stated in the document.

Furthermore, you would be taking complete responsibility for your activities on Comera as how you use your account would be your sole responsibility. The protection of your confidential information, including your temporary OTP, also comes under this. Moreover, any ramifications that might arise from any illicit or criminal activity, and the violation of eligibility terms, would fall under your responsibility.

Signing Up with Comera

Registration: For registration at Comera, you must share your authentic data about yourself, including the foremost requirement of the mobile phone number you are currently using. This data will be only used to process your registration. By providing your mobile number, you agree to receive verification messages (SMS) from us, or any other third-party network/service provider handling necessary processes for your account’s registration.

Address Book: By providing your mobile number, you also agree to our access to your contact list through which we verify and authenticate the particulars of our users, and also inform them if a member of their contact list joins Comera. You further agree that you are of legal age to provide us access to such information.

Age: To be able to use Comera, you must at least be 16 years old or older. Or, depending upon your geographical location, you must be of the age in which you can provide consent to necessary personal information without parental approval. If you haven't reached the permissible age and still want to use our services, your parents or guardian must agree to our Terms of Use on your behalf.

Data/ Information: Comera will require certain information so that it could provide you with its services. By doing so, you confirm to us that you are sharing this information with your consent and that you also agree to receive messages from us, or other third-parties. You also agree to receive phone calls from us, or other third-parties, helping us provide you with our services.

User Privacy: Your privacy matters to us at Comera. The information that is received from your end, is used by the system to provide you services. By using Comera, you agree to the processes involved, which include the transmission of the information provided through different channels that include our facilities, service providers, and other partners. You also acknowledge that the country where you are residing; its rules and regulations about the usage of information might differ from the country from which we provide you with our services. Our Services

Device and OS Information: Usage of Comera implies automatic download and installation of its app and related updates meant to improve your in-app experience.

Service charges: All kinds of network plans and carrier charges, along with other such fees come under your responsibility. Any additional taxes, too, are the responsibility of the user. Furthermore, we may charge you for using our services, and this shall include taxes. We, at Comera, reserve the right to refuse, reject, or cancel certain app-related requests. Comera is not liable for any refunds, except the ones required by law.

DISCLAIMER: Comera does NOT replace your mobile and landline phone and SMS services. There are clear differences between those services and Comera. Furthermore, the app does NOT provide any EMERGENCY SERVICES or any DIRECT CONNECTION TO ANY EMERGENCY PROVIDERS. Emergency services including, police, hospitals, or fire departments, or other such services come under this. Please ensure that you can contact emergency service providers IN CASE OF AN EMERGENCY through means of mobile or landline services, or any other service.

Violations of Terms and Conditions

The usage of Comera must be under the stated guidelines, terms, and policies. The violation of this agreement (coming into force at the installation of the app) shall result in the suspension or termination of your account. In such a case, you are not allowed to create another account without prior permission of Comera.

The Policy of Lawful Usage

The use of Comera shall only be for legal purposes which means that users shall not use this application for any purpose/act which is prohibited by the law of the state where user is located. It entails extreme precaution that the user does not violate the rights of safety, privacy, intellectual property, reputation and non-threatening communication experience of other users, as well as the expanded community (local, national, or international). Any act of harassment, intimidation, impersonation, defamation, obscenity, racism, casteism, homophobias, ethnicism, and incitement to violence or other violent crimes will also come under this. Furthermore, an activity like bulk messaging, auto-dialing, auto-messaging, and spamming essentially including the transmission of unwanted messages, false information, phishing, scamming, unwarranted calls, etc., will also come under the ambit of illegal and forbidden communication. In addition, this application shall not be allowed for telemarketing or telesales.

Kindly note that any exchange of data or information that is considered illegal by laws of the state, country, or any other form of jurisdiction is not permitted. Any transfer of knowledge that may be considered sensitive including but not limited to the information on nuclear or any other means of mass destruction comes under this. In case of violation of this particular clause, not only your Comera account may face suspension, but the state machinery may also come into action against you.

Applicable Laws and Dispute Resolution

Our Privacy Policy and any relationship between us and you in connection with the use of our App shall be governed by construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Abu Dhabi.

In case of a dispute arising from any function/part of the App, or any clause stated in the Privacy Policy, it shall be resolved in the following manner:

Approaching Comera: You will email the details of your dispute/complaint at the email address provided in the contact section, and Comera will attempt to satisfy you or resolve your claim within a period of 3 months from the date of receipt of your complaint/dispute notice. Your email must have the following particulars stated explicitly:

  • Your name
  • Operational contact details (Email Address, Phone Number, Mailing Address, etc.)
  • Details of the claim along with any measures you took on your own to correct the issue at hand
  • What remedy or corrective measure you seek from Comera for your inconvenience

If your complaint or dispute raised by you is not resolved pursuant to the above paragraph, such dispute shall be referred to and finally resolved by the courts of Abu Dhabi. Additionally, if you are a user of the services based in the United States or Canada, we both agree that all the matters of grievance will be resolved through individual action before the court of Abu Dhabi and not a class action before any court or tribunal. We agree that there will be no consolidated disputes or disputes involving any third party/entity.

Similarly, if we have a claim, complaint or dispute against you, we may at our own discretion, either file such claim or complaint before a court in the place of user’s/your residence or before the courts of Abu Dhabi, whichever we find convenient.

Safety and Security
Comera and its Community

You are not permitted to make use of Comera in any way that may harm its regular operations (including but not limited to reverse-engineering, code alterations and extractions, virus or trojan injections, account creation through automated means (using bots), or attempts of hacking or the regular usage of other users.

Any effort to gain access to the services of Comera through any unauthorized means (dummy phone numbers, bots, or email addresses, etc.,) will also be considered as damage to the services of the app and will result in immediate termination of the account. The usage of our services over one network operated on multiple devices also comes under this.

Privacy

All kinds of attempts to collect any private information of other users through unauthorized means, including hacking into their accounts or trickery will also be considered damage to Comera and its community. The result of such an act would be the immediate termination of the account. As a Comera user, you must keep your device and the data of your account that falls out of the app's in-built privacy features, safe and secure. Giving some access to the data is purely your responsibility. You also agree that once you install the app, you will notify Comera immediately on gaining any knowledge of a possible breach of either your data or the services of the app.

Usage of Third-party Services

While using Comera, you have the right to use certain third-party apps that protect your data or add to your privacy (iCloud or Google Drive, App Lock), or enhance your overall experience (sourcing videos, images, links, documents, etc.,) through certain third-party apps. When using these apps, however, their terms of services and privacy policy shall also be applicable upon you. Kindly read their terms and conditions properly before using the services.

Status of Services
Inaccessibility

At any time during your usage of our app, there is a possibility that there might be partial, temporary, or even permanent inaccessibility or termination of our services. Following reasons may be responsible for this:

Maintenance

Performance of required maintenance or repairs of the software or hardware behind the app. This shall also include events in the nature of force majeure, which may result in disruption or termination of our services.

Updates

Upgradation of the app which may at times result in either the addition of new features as a replacement to the old ones or complete termination of certain features that were previously part of the app. Certain changes might appear in the Release Notes accompanying updates.

Violation of Terms and Conditions

On finding credible reports and evidence of your violation of any clause of our terms and agreement as stated in this document, your account may face suspension.

Licenses and Rights

Our Terms: You must adhere to our terms and stated policies. Moreover, certain rights and licenses govern the usage of Comera, and also the information and other details that we receive from your end.

Licenses

Your License to Comera: To get access to Comera services, you grant us a global, royalty-free, license. The said license includes distribution, reproduction, creation of derivative works, exhibition, and performance of the information. This information that you upload, submit, store, send, or receive on or through Comera or any of our services is used to provide your services and is not kept by us

Comera License to You: We grant you a revocable, limited license to use our services, as per our terms. The sole purpose of this license is to enable you to use Comera as per stated terms. You have no other licenses through any implication.

Rights

Comera does NOT claim any ownership of the information that you provide to us for your account. Nor does it claim the ownership of the information that we receive through any of our services. You have all the necessary rights to any such information that is submitted by you for your Comera account. You have the right to grant us the rights and licenses that are necessary for our application and its services. Comera owns all domains, logos, trademarks, trade dress, trade secrets, patents, copyrights, and other related intellectual property rights that are associated with it. You may NOT use our domains, logos, trademarks, trade dress, trade secrets, patents, copyrights, and other intellectual property rights. Exception, in this case, is ONLY if you have our express permission, OR it is under our brand-related guidelines. Any violation will be dealt with severely.

THE FOLLOWING DISCLAIMERS ENTIRELY GOVERN YOUR USAGE OF THE APP: THE RISK ASSOCIATED WITH USING OUR SERVICES AT YOUR END, INCLUDING THE RISK TO DATA, PRIVACY, AND THE MISUSE OF INFORMATION YOU PUBLICLY SHARE IS ENTIRELY YOURS. COMERA PROVIDES NO WARRANTIES OF ITS PROTECTION. IT ALSO PROVIDES NO WARRANTIES OF PROTECTION FROM HARMFUL VIRUSES OR CODES THAT MAY RESULT OUT OF YOUR IMPRUDENT USE OF THE SERVICE. THE WARRANTY IS ALSO NOT PROVIDED ON THE FACT THAT YOUR USAGE OF THE APP WILL REMAIN ERROR-FREE OR WITHOUT ANY GLITCHES. FURTHERMORE, COMERA HOLDS NO RESPONSIBILITY FOR THE INFORMATION OR THE COMMUNICATIONS THAT OUR PATRONS COMMIT AND PERFORM OVER THE APP. YOU ALSO FREE US (INCLUDING OUR STAFF) FROM ANY LEGAL CLAIM OR COMPLAINT YOU MAY HAVE AGAINST ANY THIRD-PARTY ACTION PERFORMED ON THE APP.

Indemnification:

Comera shall be entitled to be defended and indemnified from and against any damages, expenses, liability and losses arising from or in connection with any misrepresentation (made by you), your access and use of our Services and also the breach of our terms.

Severability:

If any provision or part-provision of these “Terms of Use” is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not, in any way, affect the validity and enforceability of the rest of the terms.

Further Information
  • The terms may get updated with time, therefore, recheck them after the passing of a certain period to make sure you are aware of any changes.
  • In case there is a mutual agreement between you and Comera with a different set of terms and policies, the policies stated here will govern your usage of the app. In case of a mutual agreement between us, it will remain limited to your usage only and will not be transferable to anyone else.
  • We may use the valuable feedback you provide to us to improve the services without any compulsion to compensate you for it.

These terms of use are being agreed and entered into with Avrioc Techologies LLC who owns and controls Comera.
